Important Notice: *All payments to WebDesignJunkie are non-refundable.*
1. The Rules and Regulations stated are subject to all of WebDesignJunkie.com's contractors, agents, invitees, representatives, associates and visiters. Thus, anybody who is in any way connected to WebDesignJunkie.com must comply with these rules. There are absolutely no exceptions and failure to comply with these rules and regulations will lead to the freezing/banning of your account, whither paid or not. However, in some cases, WebDesignJunkie.com may charge a fee instead of freezing an account or service.
From hereon, WebDesignJunkie.com and its associates will be known as, "us", "we" or "our". The customers will hereon be known as, “you”, “they”, “your”.
2. All services provided by us may only be used for lawful purposes. Transfer, storage or presentations of any material, which violates American Law, are prohibited and an immediate deletion of your account will apply. These include, but are not limited to: material we believe are threatening, in-proper use of copyright material, exploitation of copyrighted material. It is forbidden to host IRC (Internet Relay Chat). Violation of Rule #1 may lead to legal charges by American Courts.
We do allow adult hosting as long as its legal content as long as its considered legal! NO CHILD PORN, NO BEASTALITY, NO WATERSPORTS, NO SHITTING, OR ANYTHING TO BE CONSIDERED OBSCENE! (We have Different Name Servers for Adult Hosting)
3. The display, transfer, storage or linkage to any: Pirated software, hacking programs, warez, cheat programs or anything we believe are similar or are under these categories are prohibited from use. NO IRC CHATS, OR COPYRIGHT INFRINGMENT from downloading music, videos, movies and placing them on the server. Your account will be immediatly Suspended until you agree to have content removed, if it happens a second time your account will be deleted with out notice, this is illegal!!!
You may have an adult site but all adult sites must be of legal content, nothing obscene, all sites must have a warning entrance page letting the visitor know they have arrived on an adult site and have the option to leave or enter.
4. You agree that any damage or claims against you through the use of our services are your sole responsibility and we have no obligations or liabilities towards your actions as a member. You will therefore hold full responsibility to any actions held against you or any damage caused. Any charges or legal actions that are conducted against you will be your full responsibility, with us having no connections to any accusations, no matter the cause.
5. We reserve the right to freeze any bodies services at any time if they do misuse their service with us, which are stated on this page. You will be notified with a warning statement 2 times. Failure to follow the rules and regulations and further misuse of our services after 24 hours of the 1st warning statement being sent, we will send one more and give you another 24 hours, after that your account will be suspended, banned or withheld from you until further notice depending on the severity of the violation.
6. We reserve the right to question anybody associated with us if they have done something against these rules and regulations. All information will be withheld by us and will not be presented to any third-party, which includes but is not limited to: Internet Marketing Companies, Advertising Agents and other companies. However, we reserve the right to use any information you give to us if legal action is taken against us. Information may be used against you if we find it adequate when the misuse of our services continues after the warning statement.
7. We may change any of these rules and regulations at any time without prior warning. Once changed, all rules and regulations will apply within 48 hours of the submittion. Any allegations against any changes of the rules and regulations will be dismissed and any further allegations may result in a freezing/banning of your account. However, if we do give prior warning, we will notify you via electric mail (e-mail) at least 7 days before the submittion date.
8. All services may be used by you for a fee unless otherwise stated. Where there is a charge, we reserve the right not to accept your application for any of our services until we have received the payment, unless otherwise stated. The fees for each service may change at any time without prior notice. Any allegations against any changes of the fees of our services will be dismissed and any further allegations may result in a freezing/banning of your account. However, anybody currently under a service will pay under the fee that was charged when they applied for one of our services. This is true for all members and services unless stated otherwise.
9. We reserve the right to change any information, which includes but is not limited to: the amount of storage space, the bandwidth, the number of mails and other options encrypted into each service. Any allegations against any changes of the information of the services will be dismissed and any further allegations may result in a freezing/banning of your account. However, anybody currently under a service will not be entitled to any of these changes. All information and benefits of the service/s that you applied to you before will still be active for the life of your account.
10. Incase there is a change of information or fees for our services and in the case that you were in the middle of the sign-up process when these changes were made, you wil still pay the amount you signed up for.
11. Your account is your sole responsibility. If ever you lose your account via means of stealing, which includes but is not limited to: hackers who give programs pretending to help you, but in the end back-stab you; giving your password away to anybody else or losing your account due to a scam, you are not allowed to sue or make allegations towards us. We are not entitled to refund you, especially if it is your own actions, which cause your account being stolen.
12. We will charge you the balance of contract(if applies to you) if you decide to cancel your service/s with us at any point in time. You are obliged to pay this fee and if not, your account will continue to run till the end of your service plan. You will have to continue to pay until your service plan with us has expired. If you do not pay, we have a right to suspend your account and proceed with legal action against you, using information obtained by us from you.
13. In the case of a mistake when we accuse you of violating any rules or regulations, you may state so in an e-mail to us, or, via other means of contact. Your message, if by e-mail, will be read within 24 hours. If by postage, your message will be read within 5 working days after the message is received.
14. Our decisions are final and you agree that you will understand our decisions as rational and absolute. You also agree that all decisions and instructions by us will be followed and carried out. In no way will you object to any of our decisions or instructions. Objections may lead to the deletion of your account with prior warning.
15. All information provided by you must be true or else we are entitled to delete your account at any time within your service plan period. We have the right to check that your details are true, including, but not limited to: e-mailing you, posting to your residential address and phoning you. Your information will not be given to any third-party. Also, in the case that you forget your password, your personal information that you provide for us may be used to identify you.
16. If you ever lose your password via any means and cannot provide correct answers to questions that we may ask you, whether it be your personal information or a secret question, you will not be able to enter your account. We are not entitled to give you your account if you cannot answer all questions that we may ask you correctly as there is no telling whether you are the rightful owner of the account or not. Therefore, no accusations, allegations or legal actions may be presented against us.
17. You agree that you will not resell the services that we provide to you in any way. This includes, but is not limited to: using our servers as your own hosting servers, using our servers as your own domain hosting and using your own service for FTP-accessed webhosting. Your account will be deleted on the spot no questions asked. This is very clear you cannot resell this account to anyone That I mean!
18. If you do not read all of the rules and regulations or/and if you do not follow any instructions that may be set out in the rules and regulations, your account may be deleted without prior warning at any time during the period of your service plan. Also, anytime a deletion occurs of anybodies account/s via any reason described by us, they may not receive a refund.
19. Purchased sites and Account Abandonment: If you purchase hosting thru us and domain including prepaid and/or Scripts, and your hosting is about to expire and you dont respond to my emails or requests for payments your account will be withdrew, and your contract with me will be null and void, therefore if you purchased a site from me, and you are failing to run it, or pay for hosting or domain renewal, I will, which makes it legally mine. So please remember to let me know if your going to be gone or you quit. This pretty much goes with customers who have purchased sites from me, but yet to have them transferred to there name and have now abandoned them, non of the sites I take control of after your abandonment will be returned to you, We originally had an contract and if you fail to fullfill it then you lose!
20. WebDesignJunkie.com will do whatever we can to make sure services are fully available to you 24/7 however in the event we will not be held liable/responsible of downtime, or unscheduled interruption, Meaning no refunds.
21. Unmetered Services as for them, there is a limit theres a limit to everything. So as far as space our unmetered space your allowed up to 20GBs of Space which all of our reseller accounts that are unmetered not one is using over 5GBs of Space. Also the Unmetered Bandwidth is limited at 350GBs, so if you go over this we'll contact you immediatly we wont suspend your account first we'll contact you. So dont worry about that we are here to make things work for you, and to keep you up and running and we are very reasonable as far as our upgrades. I must also add that this is more than a sufficient amount of space and bandwidth for any reseller, and can be quite profitable for them. Especially with our 100% Uptime!
22. Sending Spam is not permitted! If your account is reported for spamming it will be investigated you will be warned, and if it continues your account will be suspended and 7 days later deleted! If you are running a PTR, PTC or Affiliate type of site please dont worry about being accused of spamming I'm totally aware of how these sites work!
23. Phishing if your account is found to be in violation of sending phishing websites your account will be deleted on the spot, I will not tolerate that one bit! If your a reseller and your customer has an account used for phishing your account will not be found in violation just your customers account. We will promptly take action for you!
